This Platform is normally available to users at all times, subject to technical difficulties and applicable maintenance times. Accordingly, WINNCARE will make every effort to notify users in advance of the dates and times scheduled for maintenance work. 

Users hereby acknowledge that they are aware of the possibility of technicalities and unforeseen events affecting uploading/downloading times, queries and other transactions carried out on the Internet, where the nature of the network itself makes it impossible to know the recipient's speed, the route taken by the data or the bandwidth availability rate. 

Description of services provided

WINNCARE markets distance learning courses made available on-line via the platform at https://winncareacademy.com. All WINNCARE trainers declare any associations that may lead to a conflict of interest and undertake to fulfil the following obligations and commitments: duty of probity, independence, impartiality, confidentiality, professionalism and reservation. 

The training programmes are listed on the Platform. The programmes are provisional: there may be last-minute changes to the content of the talks or speaker profiles. Details of the programmes are given in the training brochures, together with the supervision procedures and types of evaluation. All the information published on the Platform is for information only and is subject to change.

Intellectual property and infractions

WINNCARE is the owner of the intellectual property rights or holds the rights of use for all the contents available on the Platform, especially the texts, images, graphics, logo, icons, audio and software. Any reproduction, representation, modification, publication, adaptation of all or part of the elements on the Platform, regardless of the means or process used, is forbidden unless previously authorised in writing by WINNCARE.

Limitations of liability

WINNCARE hereby declines all liability for any direct or indirect damage caused to the user's equipment when accessing the Platform at https://winncareacademy.com.

WINNCARE reserves the right to delete any content placed in this space that contravenes applicable laws in France, especially laws on data protection, and to do so without prior notice. If necessary, WINNCARE also reserves the right to file civil and/or criminal claims against the user, especially in the event of racist, insulting, defamatory or pornographic messages, regardless of the medium used (text, image, etc.).

Processing of personal data

The categories of personal data that may be collected by WINNCARE include: 

  • registration and profile data collected during the registration process; WINNCARE collects personal data, such as company name and the user's first name, last name and email address in order to identify each user on an exclusive basis for access to their personal space; 
  • the tracking of your actions on the Platform as necessary to follow each user's personal progress; said progress is associated with a user and is not subject to personal processing by WINNCARE; 
  • the use, visual displays and technical information collected during the use of the service (use of cookies and other technologies). 
  • the default storage period is 3 years from the last use or user login. The data is stored and processed in France.

The password is an important part of the security system and users are responsible for keeping their passwords and accounts confidential and for all activity under their accounts. Users must email reports of any abuse or compromise of their passwords to WINNCARE at formation@winncare.fr as soon as they become aware thereof. 

In accordance with the European regulation on the protection of personal data, EU 2016/679 (GDPR), data subjects have the right to access, rectify and limit the processing of their data, as well as the right to object and the right of portability thereof, where applicable; said rights may be exercised by contacting WINNCARE by post at Winncare France, Bâtiment Mozaïk - 23, rue François Jacob - 92500 Rueil Malmaison.

Applicable law and jurisdiction

Any dispute in connection with the use of the site at https://winncareacademy.com shall be governed by French law. Exclusive jurisdiction falls to the competent courts of Paris.
